Conditions of Sale

All property is sold "as is", and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. All sales are final, no returns under any circumstances. Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored. The highest bidder as determined by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or re-offer the lot for sale. If any dispute arises after the sale, our sale record is conclusive. Although in our discretion we will execute absentee bids or telephone bids as a convenience to clients who are not present at auctions, we are not responsible for any errors or omissions in connection therewith. All purchases are subject to 6% Pennsylvania state sales tax unless the purchaser possesses a Pennsylvania sales tax exemption number. Exemption numbers from other states are accepted if presented with a business card or letterhead. We reserve the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. 15% buyers premium (discounted to 10% for live, in room bidders) applicable to all lots sold. Payment to be made in five (5) days from invoice date via credit card, debit, cash, checks, money orders, cashier checks or wire transfers. Checks are held for ten (10) business days. Payments should be mailed to: Girman Auctions & Appraisals, LLC 627 Wyoming Ave, West Pittston, PA 18643. International purchases exceeding $1,000 require a wire transfer of funds. $50 fee to be applied to total. Girman Auctions will assist the buyer in arranging shipping through our preferred shipper. Shipping is subject to any restrictions of the purchaser's country. Girman Auctions provides shipping for firearms (except antique or no registration required {NRR} firearms). The cost is: Long guns: $50 for first long gun; $25 for each additional long gun won. Handguns: $65 for first handgun; $35 for each additional handgun won. Shipping for all non-firearm items and NRR firearms is the responsibility of the buyer. Girman Auctions will assist the buyer in arranging shipping through one of the listed shippers. NOTE: Items to be picked up or shipped within one week of the auction date, after which storage fees in the amount of $5 per item per day will apply.

Firearms Bidder Notice Terms/Conditions

Bidder Registration. All Bidders must register and be issued a Bidder Number prior to bidding at the Auction. GAA may refuse to accept a Bidder Registration from any potential Bidder, may refuse to issue a Bidder Number to any potential Bidder, and, if a Bidder breaches any Bidder Terms and Conditions or engages in improper conduct, GAA may reject any bids made at the Auction and may revoke any Bidder Registration or Bidder Number. By registering to bid at the Auction, each Bidder acknowledges and agrees that such Bidder has read, understands, and agrees to be bound by, these Bidder Terms and Conditions. In the sole and absolute discretion of GAA or the Calling Auctioneer may accept a bid from a Bidder who has not registered or been issued a Bidder Number provided that such Bidder immediately completes a Bidder Registration, is issued a Bidder Number, and agrees to be bound by these Bidder Terms and Conditions.

Firearms and accessories are offered and sold subject to all applicable federal, state, and local statutes, ordinances, and regulations. All modern guns must be registered to the Buyer. Firearm registration is handled by GAA, and all firearms shipped must be delivered to the holder of a Federal Firearms License. Additional fees will apply to registration and delivery of all firearms. Modern handgun purchasers must be Pennsylvania residents at least 21 years of age and must have photo ID (driver's license). Out of state residents must have a FFL or a licensed dealer in their state to receive shipment of pistols and/or revolvers. Modern rifle and shotgun purchasers must be at least 18 years of age. GAA will process all firearm purchases through the Pennsylvania Instant Check System ("PICS'). Each Bidder is responsible for knowing and complying with laws in his, hers, or its jurisdiction concerning the purchase, possession, and transportation of firearms and accessories prior to bidding, and a Bidder will not be relieved his, her, or its payment obligations should such bidder be unable to take ownership or possession of any firearms or accessories purchased at Auction. Should a Bidder be precluded from taking ownership or possession of any firearms or accessories, GAA and Seller may, in their discretion, (i) re-list and re-sell the Lot(s) in question with the Bidder being liable for any and all damages (including compensatory damages, incidental damages, and consequential damages), or (ii) retain the Lot(s) in question and accept the Purchase Price (including the Hammer Price and the Buyer's Premium) as liquidated damages. GAA endeavors to accurately catalogue and describe all firearms offered at Auction; however neither Seller nor GAA guarantee the character, quality, authenticity, validity, or condition of any Lot.

ALL FIREARMS AND ACCESSORIES ARE SOLD "AS IS" AND "WHERE IS" "WITH ALL FAULTS AND DEFECTS, INCLUDING HIDDEN DEFECTS." ANY DESCRIPTION PROVIDED BY GAA OR SELLER IS FOR IDENTIFICATION PURPOSES ONLY, AND EACH BIDDER IS RESPONSIBLE FOR INSPECTING ALL LOTS PRIOR TO BIDDING IN ORDER TO DETERMINE THE CONDITION, AUTHENTICITY, CORRECTNESS, AND USABILITY OF ALL FIREARMS AND ACCESSORIES. NEITHER GAA NOR SELLER MAKES ANY WARRANTIES AS TO THE CHARACTER, QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FITNESS FOR USE, SAFENESS TO FIRE, SAFENESS TO STORE, OR RELIABILITY OF ANY FIREARM OR ACCESSORIES (INCLUDING AMMUNITION AND PARTS), ALL OF WHICH WARRANTIES ARE EXPRESSLY DISCLAIMED. THE POSSESSION, STORAGE, AND USE OF ANY AND ALL FIREARMS AT THE BUYER'S RISK.

GAA shall not be liable for any accident, injury, harm, loss, or damages resulting to any person or property from the use or storage of any firearms or accessories, and each Buyer agrees that he, she, or it will indemnify GAA and hold GAA harmless with respectthereto, including costs, expenses, and attorneys' fees.
