Absentee Bidding Terms

We understand attending live auctions doesn’t always work with your schedule. This is why we accept pre-bids via phone within 24 hours before the start time of the auction. The process is simple. Simply contact us @ 888.367.1311 and one of our knowledgeable staff members will be able to answer questions about the any of the lots involved and take your maximum bid so you don’t miss out on that great piece you’ve had your eye on. Bids submitted via phone will be executed by a member of our staff. If you are the highest bidder you will receive a call within (24) hours after the close of the auction to complete payment and process shipping (if not pick-up only).

Bidding Online:

With Kings Auction Online Bidding Platform you can now bid in the comfort of your own home. As always be aware that there may be different terms of sale, deadlines, shipping terms and buyer’s premiums when bidding online.

Item Description & Condition

Kings Auction & Appraisal does their best to accurately describe the condition of every item listed in their auctions as a courtesy to their clients. However descriptions of an item and/or its condition are only opinions and should be treated as such. Kings Auction and Appraisal is not liable or responsible for errors or omissions. Bidders are encouraged to review all photos thoroughly and call us at 888.367.1311 should they have any further questions regarding the items specifics. All Items are Sold “As Is” with No Guarantees or Warranties stated or implied regardless of condition, fitness, operation, etc. It is the sole responsibility of the bidder to examine all materials prior to placing a bid. Kings Auction & Appraisal does not accept returns.

Buyer’s Premium:

Kings Auction & Appraisal Charges a 13% Buyers Premium on all lots.

Payment:

Purchases in excess of $2,500 or more require a 50% payment at close of sale or time of purchase with the remaining balance to be paid in full with approved check, money order, cash or credit card within 5 Business Days from the date of sale.

Payment is due for your item(s) upon receipt of invoice. Phone & Absentee bidders will be notified about their purchase within (24) Hours from the close of the sale, at which time the balance will be due in full. We accept payment in the form of Cash, Approved Check, Money Order or Credit Card.

If an alternative method of payment has not been arranged and approved with Kings Auction & Appraisal, they reserve the right to charge 50% of the invoice to the credit card on file for any bidder who has not paid in full within 7 days from the auction date. If full payment is not received within 5 business days, then the deposit is forfeited and Kings Auction & Appraisal has the right to claim or re-sell the items.

Shipping Rates & Quotes:

Kings Auction & Appraisal will combine items to reduce shipping related expenses whenever possible. Because of this they cannot post shipping expenses prior to the close of the Auction. Kings Auction & Appraisal strongly suggests you contact them prior to bidding to make shipping arrangements and get a quote before bidding on any lots.

Terms of Sale

By registering to bid on this auction you agree to the following terms and conditions.

Payment is due for your item(s) upon receipt of invoice. Absentee & Phone Bids will be notified within (24) Hours after the close of the Auction. We accept payment in the form of cash, approved check, money order, approved check or Credit Card.

  1. All items are sold as is, where is. There are no warranties or representations of merchantability of any kind, express or implied. All items are available for inspection prior to bidding. Your bidding will signify that you have inspected the items and understand all terms. Written and/or oral descriptions on functionality, condition, fitness, quality and rarity are our opinions and should in no way be construed as a guarantee of any kind as to age, condition, materials, provenance or any other feature of items being sold. All sales are final with no partial or full refund available. No statement written or oral made by the auctioneer or any employee of Kings Auction & Appraisal shall be deemed a warranty or assumption of liability by Kings Auction & Appraisal or by any seller represented by Kings Auction & Appraisal.

  2. Bidding will begin at a price determined by the Auctioneer. The auctioneer has full discretion regarding accepting or declining any bids. No bids will be accepted that are 50% lower than the posted starting bid Online. All lots in this catalogue may have a reserve, which will remain confidential unless seller would like it to be known or printed. In executing a reserve, the auctioneer has the right to bid on behalf of the Consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve.

  3. Once Kings Auction & Appraisal declares that an item is sold, they cannot re-open the bidding. The Auctioneer reserves the right to reject any bids deemed inappropriate or to withdraw any item(s) for lack of appropriate bids. If an item is withdrawn from the auction it will be offered again only at the auctioneer's discretion.

  4. Full Payment for successful absentee, phone bids and online bids are required within (5) business days of the auction. Bidding on an item indicates the client's acceptance of our Terms of Sale. By Submitting an absentee bid you are accepting these terms and give Kings Auction & Appraisal permission to charge successful bids to credit cards if payment is not received within five days of the auction. In the event the buyer does not pay in full within seven days of the sale, the buyer is in default, therefore title has not exchanged. In the event of a buyer default, the buyer agrees to pay Kings Auction & Appraisal a 35% default fee and releases title and ownership of that said item. 

  5. In the case of identical absentee bids, the bid received first will prevail.

  6. Purchaser agrees that packing and shipping is done at the purchaser's risk and that the purchaser will pay in advance all packing expenses, materials, carrier fees and insurance charges. Please allow up to (14) Business Days for shipping after payment is received. Shipments requiring freight is the responsibility of the purchaser. Kings Auction Appraisal will not be responsible for any damage or delay.

  7. All Buyers residing in the state of Kansas will be responsible to pay Kansas sales tax unless the Kansas Certificate of Resale tax form is fully and completely filled out and received prior to time of purchase. Resale tax numbers from other states are accepted. International buyers are responsible for tariffs, taxes, or assessments of shipped items to the buyer's country. Items shipped out of state are not subject to sales tax.

  8. Bidding on an item indicates your understanding and acceptance of these Terms of Sale. If a purchaser breaches any of these Terms of Sale, including the obligation to pay for purchased items, Kings Auction & Appraisal may seek all remedies under the law.

  9. A 13% buyer's premium will be applied to all purchases.

  10. All photos and descriptions posted by Kings Auction & Appraisal are property of Kings Auction & Appraisal and are subject to US copyright laws. No photo or description may be used without written approval by a Kings Auction & Appraisal agent.
