CONDITIONS OF SALE

Effective date June 1, 2017

(ANY ADDITIONAL TERMS OR CONDITIONS OF SALE, ADDED BY AUCTIONEER, SHALL BE ANNOUNCED AT THE BEGINNING OF SALE. The auctioneer reserves the right to add one or more of the following terms and conditions of sale).

“Galleries”, whenever used in the Conditions of Sale, means Randy’s Auction Gallery Ltd.

The Galleries and the Consignor assume no risk, liability or responsibility for the authenticity or the authorship of any property sold (that is, the identity of the creator or the period, culture, source of origin, as the case may be).

All property is sold “as is” and neither the Galleries nor the Consignor makes any warranties or representations of any nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty of description, genuine, attribution, provenance or condition of the property and no statement made at the sale or in the bill of sale or invoice or elsewhere shall be deemed such a warranty or representation or an assumption of liability.

The Galleries reserves the right to withdraw any property at any time before actual sale.

If one is unable to attend the sale in person, the Galleries will execute bids without charge and without responsibility for errors and subject to the Conditions of Sale. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalog. The Galleries reserve the right to reject the bid from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and to resell the article in dispute. If any dispute arises after the sale, the Galleries sale record shall be conclusive in all respects.

If the auctioneer determines that any opening bid is not commensurate with the value of the article(s) offered, he may reject the sale and withdraw the article(s) from the sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is not of sufficient amount, he may reject the advance.

On the fall of the auctioneer’s hammer, title to the offered lot or article will pass to the highest bidder, who, thereupon (a) assumes full risk and responsibility therefore, and (b) will pay the full purchase price therefore or such part as the Galleries may require. All properties shall be removed from the Galleries by the purchaser at his expense not later than three days following its sale and, if not so removed, may be stored at Randy’s Auction Gallery Ltd. for the account, risk and expense to the purchaser. If the foregoing conditions or any of the applicable conditions herein are not complied with, in addition to other remedies available to the Galleries and the Consignor by law, including without limitation the right to hold the purchaser liable for the bid price, the Galleries, at its option, may either (a) cancel the sale, retaining as liquidating damages any payments made by the purchaser or (b) resell the property on three days notice to the purchaser and for the account and risk of the purchaser either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including warehousing, the expense of both sales, and the Galleries’ commission at its regular rates and all other charges due herunder and incidental damages.

Unless the sale is advertised and announced as a sale without reserves, each lot is offered subject to reserve and the Galleries may bid through its representatives as agent for the consignor.

Unless exempted by law from the payment thereof, the purchaser will be required to pay the Virginia State sales tax. The rate of such tax is 6.0%.

Prior to the sale, all bidders must register with the Galleries office and receive a bidding number. A bidding number will be required of the successful bidder at the fall of the auctioneer’s hammer for each lot.

Full payment must be made on each and every purchase and before the items leave the premises on the date of purchase by cash, check, or approved credit card. All sales are final. Personal checks will be accepted only if credit has been established with the auctioneers. The Galleries reserves the right to hold merchandise purchased by personal check until the check has cleared the bank of the Galleries deems such action necessary to protect the interest of the consignor.

Persons attending during exhibition, sale or removal of goods assume all risks of damage or of loss to person and property and specifically release the Galleries from liability therefore. Neither the Galleries no his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.

Prospective bidder should inspect the Property before bidding to determine its condition and whether or not it has been repaired, restored or altered. If a prospective purchaser has not examined the Property to his own satisfaction before the sale or had an agent do so for him, Randy’s Auction Gallery Ltd. recommends that he not bid on the Property.

Randy’s Auction Gallery Ltd. reserves the right at its complete discretion to publish post sale any or all of the prices realized and to reproduce photographically or permit others to reproduce photographically, any of the items which Randy’s Auction Gallery Ltd. photographs prior to our sale. Unless you notify Randy’s Auction Gallery Ltd. in writing to the contrary, you agree that Randy’s Auction Gallery Ltd., at its own discretion, may use your name or your principal’s name as the consignor or purchaser as the case may be.

15% BUYERS PREMIUM 5% DISCOUNT FOR CASH OR CHECK ON ALL AT GALLERY BIDDING IS IN EFFECT FOR ALL BIDS.

 All merchandise sold as is and where is. After Auctioneer hammers final bid to highest Bidder, merchandise is then Bidder’s responsibility.

Online Auction Terms

Every auction lot is sold “as is, where is, with all faults known or unknown” without warranty or guarantee of any kind. Inspections of lots are provided by photos or special preview before and during the online auction. Bidders are asked not to bid on or purchase any item or a lot they have not inspected to their complete satisfaction. Upon knock down the item or lot becomes the responsibility of the buyer. Every effort is made to describe the condition of the item accurately. ALL SALES ARE FINAL.

A 19% internet buyer’s premium is in effect for all bids.

Visa, Mastercard, American Express are accepted for payment.

All paid for items must be picked up by the published time schedule. If not, the items will be deemed abandoned and become the property of Randy's Auction Gallery Ltd. . Please do not bid if you are not able to pick up your items or arrange for shipping. THERE WILL BE NO CHARGE BACKS.

If you do not have an (Tax Exemption form) on file with us you will be charged the current Virginia sales tax rate. NO EXCEPTIONS. Please email completed tax exempt form to randy@randysauctiongallery.com and confirm that it was received with a phone call or confirmation email.

Please bring paid receipt with you at load out.

Registering and placing bids means that the bidder has read and fully understands the terms and conditions of the internet auction and agrees to be bound thereby.

When you bid on any item, you are entering into a binding contract. If your bid is the winning bid on any item(s) your credit card will be charged at the conclusion of the auction.
