Every attempt has been made to describe all property as accurately as possible.
The Buyer accepts all purchases at the point of delivery. Not withholding any other terms of these Conditions of Sale, should Bacchus Wine Auctioneers receive any written claims within 15 calendar days of the auction that any property is with a shortage, ullaged or otherwise out of condition, or that any lot description is without basis, Bacchus Wine Auctioneers will judge any claims through inspection of the property or by any other just means, and may cancel the sale and refund the purchase price. At all times the decision of Bacchus Wine Auctioneers will be final and binding on all parties.
The term “final bid” as used herein shall refer to the price at which any lot is knocked down to the buyer. The purchase price, due from the Buyer at the closing of the sale, shall be the aggregate of the final bid and a premium of 15% of the final bid, together with any applicable sales or use tax. The complete purchase will be due via the same credit card used during the registration process. No property will be released to the Buyer until Bacchus Wine Auctioneers receives full payment for lots purchased along with any applicable state and local taxes which Bacchus Wine Auctioneers may be required by law to collect. Any applicable handling fees must also be received prior to the release of the property.
Bidder warrants that he/she is at least 21 years of age and is purchasing the wines for personal use.
Bacchus Wine Auctioneers reserves the right to amend the description of any lot during the mobile auction, or to withdraw any lot at any time.
Unless otherwise indicated, it may be assumed that a reserve, or confidential minimum selling price, has been established on all lots. Should bidding not meet the reserve price, Bacchus Wine Auctioneers may enforce the reserve by bidding on behalf of the Producer-Seller.
The highest bidder for any lot at the close of the auction shall become the Buyer of same lot, and will assume full responsibility for the lot upon the close of the auction. Bacchus Wine Auctioneers may refuse any bid and advance the bidding at the Auction Director’s discretion. If, during the mobile auction, the Auction Director considers that any dispute has arisen between any bidders, such dispute will be resolved by the Auction Director. The Auction Director may determine to open any lot for rebidding at any time during the auction. In the event of any dispute during or after the auction, the records of Bacchus Wine Auctioneers will be final, and the decision of Bacchus Wine Auctioneers shall be final and binding onto all parties.
Bids submitted to Bacchus Wine Auctioneers are processed and executed as a service and convenience to bidders and are executed in the order in which they are received. Neither Bacchus Wine Auctioneers nor its staff or web-site shall be responsible for any failure to execute such bids or any error relating to same.
Should any Buyer fail to fully comply with these Conditions of Sale, Bacchus Wine Auctioneers may hold the Buyer liable for the purchase price or resell the property after reasonable notice is given to the Buyer.
The rights and obligations of all parties shall be governed by the laws of The State of Delaware, USA.
Payment: The credit card used to register to bid will automatically be charged for the full invoice amount of the Buyer, however, funds will only be released to Bacchus Wine Auctioneers at the point of delivery. In the event that the successful bidder is a retail license, purchases will be processed through an appropriately licensed wholesaler, if required. Should a wholesaler be required for legal importation into the Buyer’s state, a special handling charge of $25.00 will be applicable and due from the purchaser. Please note that any charge resulting in a charge back for any reason will be subject to a $25.00 processing fee. Wines will not be released until payment has been received and charges have been cleared into the account of Bacchus Wine Auctioneers.
Any wines which remain unsold due to a cancelled invoice will be placed in the next auction or returned to the Producer-Seller.
Producer-Seller may at no time bid on their own wine.
The final bid is inclusive of shipping fees. Such fees are paid by the Producer-Seller, not the purchaser. Purchaser shall pay a packing fee of $20.00 per lot.
Wines are described in this catalogue as accurately as possible.
Buyers are urged to make allowances for slight variations in ullages and conditions.

Neck:
Normal level for all wines. In wines over 10 years of age, this level suggests excellent provenance. Rarely used, except to emphasize a particularly good fill level when other fill levels in the same lot are less than perfect.
Base Neck:
A common fill level at which many Chateaux release their wine. For wines of any age, this level suggests excellent provenance.
Very High Shoulder: Acceptable fill level for wines 8 or more years of age. Suggests proper storage conditions throughout its life. Natural occurrence for wines of this age.
High Shoulder:
Usually not a problem for wines in excess of 20 years of age. This level may be caused by easing of the cork combined with natural evaporation. Check the clarity and the color of the wine in the bottle as a secondary indicator of provenance.
High-to-Mid-Shoulder:
Refer to High Shoulder and Mid-Shoulder level descriptions.
Mid Shoulder:
May suggest ullage during the life of the wine due to either easing of the cork or inconsistent storage conditions. Not abnormal for wines 30 or more years of age. As additional indicators of risk, definitely inspect clarity and color of the wine in the bottle, as well as condition of the cork.
Low Shoulder and Below:
Suggests poor provenance. Definitely a risk and generally not saleable, with exception given to rare bottlings and/or labels. Not recommended for consumption.
Because the shape of Burgundy bottles does not allow for a level rating system based on the shoulder of the bottle, levels are described by means of inches below cork.
Generally, Burgundy wines with an inch and one half fill level or above are considered normal for wines younger than 10 years of age. Wines of 15 or more years of age with fill levels of between an inch and one half and three inches are generally considered to be of sound provenance.
Special consideration should be given to the clarity and color of the wine in the bottle, as well as the condition of the cork. Burgundy bottles with fill levels lower than three inches may be at risk of being damaged or undrinkable, and therefore may be unsaleable.
It should be noted that some Burgundian producers tend to over-fill their bottles during the bottling process which may cause a few drops of wine to become trapped between the capsule and the cork. This should not be confused with ullage, a natural occurrence in older wines, which may be accelerated due to poor provenance.
Bidders should be aware of limitations and restrictions imposed by various states regarding importation of alcohol beverages, which may have been purchased at auction and brought into that states’ jurisdiction from another state. It is the sole responsibility of the purchaser to investigate, apply, obtain, route, and comply with all special permit or license requirements prior to collection or shipment of the wines purchased from Bacchus Wine Auctioneers. Bacchus Wine Auctioneers assumes no obligation of responsibility for obtaining permits or licenses on behalf of the purchaser prior to shipment. Bidders are urged to familiarize themselves with their respective states’ import statutes prior to bidding at auction to determine if, when, and how wines may be delivered directly from the winery, while remaining in compliance with existing statutes.
Complimentary pick-up is available at the lots respective winery. Please arrange your pick up by contacting the winery directly. Wine will not be released until payment has been received and funds have cleared into Bacchus Wine Auctioneers’ account. Bacchus Wine Auctioneers can arrange travel assistance to the winery, as well as accommodations at the winery upon request, in most instances, at a very reasonable rete with proper notice.
The lots’ respective winery can arrange complimentary local delivery to nearby hotels restaurants or third party carriers within a 10-mile radius of the winery.
Shipment will be at the expense of the winery, with wines being shipped from the winery direct to the purchaser (consumer). Shipping dates for your purchase can be established once payment has cleared the account of Bacchus Wine Auctioneers. Please be sure to confirm your shipping arrangements, which will accompany your paid receipt. Shipments will be scheduled in the order in which payments are received, on a first come, first serve basis. A packing fee of $20.00 per case or part thereof will be charged to the purchaser. Wines are insured through the carrier while in transit. Any loss or damage resulting from shipping wines to the purchaser will be the sole responsibility of and at the risk of the purchaser, though Bacchus Wine Auctioneers will assist in filing any claims for recovery resulting from loss or damaged of wines while in transit. Wineries will not be held responsible for any deterioration of wines, which could occur during transit. Each bottle purchased at Bacchus Wine Auctioneers is protected by a emperature tracking wine capsule installed by the winery.

Wines are shipped directly to the purchaser (consumer) from the winery. Taxation is determined by the governing body of the winery and of the final destination of the shipment. Successful bidders are required to comply with their respective states’ regulations regarding importation of alcoholic beverages.
