Lots: ZQ Art offers lots as owner or agent and contractually is the seller. Lots are in "as is" condition. Written or verbal statements describing the lots (including those in the catalog) are professional well-researched opinions and are not warranties of declared value or authenticity. No representative or employee of ZQ Art may guarantee a warranty on any property offered in the sale. Copyright of images and descriptions is that of the auction house and may not be used without permission for commercial purposes.

Bidding: Bids are offered by the auctioneer on each specific lot and made by the buyer. A buyer's bid on any associated lot is a contractual obligation to purchase. By bidding, the bidder agrees to all the terms of the sale and is bound by the regulations of these terms and conditions and any associated terms assigned by ZQ Art. Winning bidder understands and accepts the responsibility of associated buyer's premiums and applicable taxes or fees. All absentee bids must be received by 5 PM the day before the auction. Telephone and absentee bidding should be arranged as early as possible. telephone bids can only proceed on lots that have a minimum low estimate of $500. The auctioneer has the right to reject bids and advance or split bidding increments in a manner the auctioneer sees fit. The auctioneer has the right to withdraw lots and the final discretion in the closing of a lot or reopening it if it is determined the previous highest bid was fraudulent or made in error. Reserve lots may implement a reserve bidding process. Owners of lots are not permitted in any circumstance to bid on their lots.

Payment: All payments made directly (check, cash, credit card) or through third party services must be processed within 7 days of the auction's conclusion. Lots will only be released to the winning bidder after payment has cleared. All New York State residents will be assessed appropriate sales tax.

Shipping: It is the buyer’s responsibility to arrange and pay for all packing and shipping. Shipping and handling arranged directly through the auction house or via third party must occur within 7 days of the auction's conclusion. Winning items will be shipped from our Jersey City, NJ warehouse. Please notify us in writing which shipping company you have chosen, as will not release your merchandise to anyone without your authorization. The winning bidder assumes all responsibility for shipping decisions and choices and understands that ZQ Art is not liable for any damage or loss.

Liability: The auction house is not liable for any third-party disputes or losses (including any legal fees) associated with on-line bidding or payments, including but not limited to technical difficulties. The auctioneer has final discretion on when to close bids on any lot and to withdraw lots. Any questions on lots asked prior to or during the auction are provided for informational purposes only. It is the buyer or the buyer’s authorized agent who makes and is responsible for all decisions regarding purchase of any lots. It is the responsibility of the prospective buyer to inquire as to the condition of a specific lot prior to bidding. Buyers must familiarize themselves with all rules and regulations and are bound by all the terms and conditions of the auction house and associated third party platforms including on-line auction and billing services.
